⚠️ Right of Withdrawal — Not Applicable

Art. L221-28 12° of the French Consumer Code
In accordance with Article L221-28 12° of the French Consumer Code, this seasonal rental contract for accommodation services on specific dates is exempt from the 14-day right of withdrawal provided for in Article L221-18. The booking is firm and final upon payment validation.

🏡 Purpose of the Booking

The booking concerns the seasonal rental of the selected property, for the period and number of travelers indicated. It is concluded directly between the traveler and the owner, without any intermediation.

✅ Formation of the Contract

The rental contract is concluded upon validation of the online payment. A confirmation email is automatically sent to the traveler with the full summary of their stay (dates, accommodation, total amount, owner’s contact details).

💳 Payment Terms

Payment is made securely online via Stripe. The traveler can pay the full amount or a 30% deposit at the time of booking, with the balance due no later than 7 days before the arrival date. Bank data is encrypted and is never stored on the Résidence Les Palmerèves servers.

Non-payment of the balance: in the event of non-payment of the balance within the allotted time, the owner reserves the right to cancel the booking after a formal notice has remained unanswered for 48 hours, in accordance with art. 1224 of the French Civil Code. The deposit paid remains acquired as compensation.

⚖️ Tenant’s Commitments

By accepting these general conditions, the traveler undertakes to:

  • Occupy the accommodation with strict respect for the premises and the tranquility of the neighborhood
  • Not exceed the number of travelers declared at the time of booking
  • Return the accommodation in the condition in which it was received
  • Respect the house rules communicated upon arrival
  • Not organize events or gatherings without the express authorization of the owner

🔑 Arrival and Departure

Arrival and departure times are specified in the confirmation email. Any early departure will not give rise to a partial refund of the stay.

⚠️ Liability

The owner declines all responsibility in the event of theft, loss, or damage affecting the travelers’ personal property during the stay. It is the responsibility of each traveler to take out travel insurance and civil liability insurance appropriate to their situation.

⚖️ Applicable Law and Jurisdiction

This contract is governed by French law. In the event of a dispute that cannot be resolved amicably, exclusive jurisdiction is attributed to the courts of the jurisdiction where the rented property is located (Judicial Court of Fort-de-France, Martinique).
